When Do I Need Minor Variance/Permission?

If an owner wants "permission" to enlarge, extend, or change a legal non-conforming use, the owner of any land, building or structure or any person authorized in writing by the owner may apply to the Committee of Adjustment for a minor variance to one of the following municipal by-laws: Zoning By-laws 3072 and 8600, Sign By-law 7750, or Fence By-law 11858.

When are Minor Variances granted?

Minor Variances may be granted provided that, in the opinion of the Committee:

  • The request is minor in nature,
  • It is desirable for the appropriate development or use of the land, building or structure, and
  • The general intent and purpose of the zoning by-law and the Official Plan are maintained.
