The subject site is designated “Mixed Use Corridor” on Schedule D: Land Use in the City of Windsor Official Plan; is zoned Manufacturing District 1.4 (MD1.4) and S.20(1)267 by Zoning By-law 8600; has a frontage along Assumption Street of 60.96 metres, a depth of 60.96 metres and an area of 2,723.08 metres squared; and is occupied by a commercial building, an accessory structure and an asphalt parking area. An open and travelled alley abuts the parcel on the west lot line.
The applicant is proposing to develop the site for mixed use, including commercial on the main floor and residential above. The proposed development is called the "Peabody Lofts." One combined-use building is proposed to be constructed, having a building height of 67 metres (19 storeys and a penthouse), consisting of 204 dwelling units; 477.71 metres squared of commercial/retail space along Assumption Street over 2 storeys; and 285 parking spaces, including 8 accessible parking spaces and 9 visitor parking spaces, 15 bicycle parking spaces and one loading space in a 3-level parking garage. The tenure of the units will be individually owned. Access to the parking garage is from an access area to Assumption Street. The alley will be used to access one loading space and refuse.
The development as proposed is subject to Site Plan Control.
The applicant is requesting an amendment to the Official Plan by adding a Special Policy Area to allow for an increase in building height, and an amendment to Zoning By-law 8600 from MD1.4 to Commercial District 2.2 (CD2.2) and zoning exceptions (relief from building height, visitor parking spaces and loading spaces) to permit the development as proposed. The applicant is also requesting that the parcel be subject to a Holding zone until a Record of Site Condition has been completed and accepted by the City of Windsor.
