Changes to the Municipal Election Act:
An amendment to the Municipal Elections Act, Bill 212, Good Government Act, 2009 was introduced in the Ontario Legislature to streamline local government elections. This Bill received Royal Assent on December 15, 2009. The changes to the Municipal Elections Act make local elections more transparent, accountable and efficient. It also promotes greater accessibility for voters and candidates with disabilities and creates a more level playing field for all candidates.
Highlights of Bill 212:
- The election date has been moved forward to the fourth Monday of October, (October 25, 2010).
- The accuracy of voters' lists has been improved by providing the Municipal Property Assessment Corporation and municipalities with potential access to additional information.
- Voters are now required to provide identification at the voting place.
- Voting places must be accessible to voters with disabilities.
- As per Bill 212, there is a new total contribution limit of $5,000 per contributor in each jurisdiction. There is a $750 limit per candidate.
- Candidates for future elections will not be able to keep surplus campaign funds - surpluses instead would go to the local municipality.
- Expenses related to a candidate's disability would be campaign expenses excluded from a candidate's spending limit.
- Municipalities and school boards are now required to appoint audit committees to hear and decide on applications for compliance audits.
- Penalties for contraventions to the Municipal Elections Act are now up to a $25,000 fine for individuals and up to $50,000 for corporations and trade unions.
